Bioclimatic pergolas sold by La Toulousaine from February 1, 2025 benefit from the following contractual warranty:

La Toulousaine guarantees its products for 10 years from the date of shipment.

This warranty extends, at La Toulousaine's discretion, to the repair or replacement of parts found to be defective, subject to the exclusions defined below.

The Structura is guaranteed for 10 years. The paint finish is guaranteed for 10 years.

Motors, boxes, remote controls, Led receivers, Store receivers and power supplies are guaranteed for 5 years.

All other parts, including Zip Blinds, are guaranteed for 2 years.

This warranty includes only the repair or replacement of parts recognized as defective by La Toulousaine after examination, to the exclusion of any participation in any other prejudice whatsoever.

In particular, the warranty does not cover :

• the cost of removing - dismantling - re-installing products,
• deterioration due to
  • normal wear and tear and consumables (batteries, bulbs, cables, rubber seals, etc.),
  • failure to comply with the rules of the trade, standards or instructions issued by La Toulousaine when installing or using the products,
  • use for purposes other than those for which they were originally intended, even temporarily,
  • poor storage conditions,
    any hazards related to installation or misuse before acceptance of the work (knocks, scratches, etc.)
  • exceptional weather conditions
    • strong wind,
    • lightning.
  • external influences such as fire, water, salts, bases, acids, abnormal environmental conditions, various projections, force majeure,
  • negligence, poor maintenance or lack of maintenance (presentation of maintenance booklet mandatory).
• modified products or use of accessories not approved by La Toulousaine,
• products located less than 500 m from a seafront or less than 50 m from an aggressive atmosphere,
• defects or imperfections not visible at 1.5m when examined for 10 seconds with a normal view under significant lighting (in accordance with ADAL),
• breaks or malfunctions caused by adverse weather conditions or if it has been overloaded by foreign weight (e.g. snow),
• damage resulting from failure of the wall or fixing,
• water leaking onto the product from vertical walls,
• other roofs, gutters, etc,
• maintenance costs,
• non-conformity of products with commercial documentation, which is non-contractual,
• any material or immaterial damage, whether or not consecutive to a product defect.

The warranty must be invoked by registered letter, accompanied by a copy of the original invoice, within 8 days of the defect appearing. Failing this, the warranty can no longer be invoked.

It is only admissible if the purchaser is up to date with his financial obligations.

The warranty is conditional on presentation of the completed maintenance booklet proving absolute compliance with our maintenance instructions.

Defective parts must be returned, carriage paid by the customer, non-refundable, to the following address:

Parts repaired or replaced by La Toulousaine under the warranty will be returned at La Toulousaine's expense.
