GUARANTEES

The Habitat sectional doors and roll-up garage doors sold by La Toulousaine from December 1st, 2020 benefit from the following contractual guarantee

1 - Duration

La Toulousaine guarantees its Habitat garage doors for 10 years from the date of shipment.

2 - Scope

This warranty extends, at La Toulousaine's discretion, to the repair or replacement of parts found to be defective, subject to the exclusions defined below. The manufacture is guaranteed for 10 years.

Wear parts such as cables, handles, locks, wheels and any other parts that may be considered as wear parts, related to the proper use of the product, are excluded. The paint is guaranteed for 5 years. The operations are guaranteed according to the conditions of the manufacturer, and are guaranteed for a minimum of 2 years (table in appendix A).

3 - Exclusion

This warranty includes only the repair or replacement of parts recognized as defective by La Toulousaine after examination, to the exclusion of any participation in any other damage whatsoever.

The warranty is reduced under the following conditions:

  • 2 years for the Medium Oak wood finish
  • Warranty reduced to 5 years for products installed less than 5km from a seafront.
  • Warranty reduced to 2 years for products installed within 500m of a seafront coastline.

The warranty does not cover the following

  • The costs of removal - disassembly - reassembly of the products.
  • Deterioration due to
    • Normal wear and tear and consumables (battery, bulb, cable, rubber seal, etc.),
    • Failure to comply with the rules of the trade, standards or instructions issued by La Toulousaine when installing or using the products,
    • Use that does not comply with their initial purpose, even for a short time,
    • Poor storage conditions,
    • Any hazard related to installation or misuse before the work is completed (knocks, scratches, etc.)
    • Exceptional meteorological phenomena
      • Strong wind.
      • Lightning.
    • The use of non-compatible elements (e.g. cylinder motors),
    • External influences such as fire, water, salts, bases, acids, abnormal environmental conditions, various projections, force majeure,
    • Negligence or poor maintenance or lack of maintenance (presentation of the obligatory maintenance booklet).
  • Modified products,
  • Products located less than 50 m from an aggressive atmosphere or a seafront coast,
  • Defects or imperfections not visible at 1.5m on a 10-second examination with a normal view under significant lighting (in accordance with ADAL),
  • Maintenance costs,
  • Non-conformity of products to the commercial documentation, which are non-contractual documents,
  • Any material or immaterial damage, whether or not consecutive to the product defect,
  • The durability of the decorative patterns
  • Aging of the lacquer (softening, clogging, permeability, chalking, loss of shine, uniform discoloration...) which is a progressive and natural phenomenon, it is not a defect.
  • Delamination of the resins surrounding the pigments is caused by the combined action of UV, rain and pollution. The pigments will be directly confronted with the external elements. In the long term, they are on the surface and after a wipe they are found on the cloth. This is a natural depigmentation. To delay this phenomenon, it is necessary to clean your powder coated product regularly and as soon as it is installed (see our cleaning instructions and recommended products in our documentation).

4 - Terms and conditions

The implementation of the guarantee must be done by letter RAR, accompanied by the copy of the original invoice, within 8 days after appearance of the defect. If this is not done, the guarantee cannot be invoked. It is only admissible if the buyer is up to date with his financial obligations.

The warranty is conditional upon presentation of the completed maintenance booklet proving absolute compliance with our maintenance instructions.

Parts repaired or replaced by La Toulousaine under the warranty will be returned at La Toulousaine's expense.

If La Toulousaine's warranty applies to the frame or the lacquering of the frame, an estimate will be drawn up indicating the part to be paid by La Toulousaine.
